Regulamin Serwisu Internetowego AI25.Studio

§1. INFORMACJE OGÓLNE, DEFINICJE I ZAKRES USŁUG


  1. Niniejszy Regulamin określa zasady korzystania z serwisu internetowego dostępnego pod adresem https://ai25.studio wraz ze wszystkimi jego podstronami, dalej „Serwis”, zasady świadczenia usług drogą elektroniczną oraz podstawowe prawa i obowiązki Użytkowników.

  2. Operatorem Serwisu i Usługodawcą jest ANTONI SHKRABA STUDIO, działający pod marką AI25.STUDIO, ul. Jana Pawła Woronicza 31/155, 02-640 Warszawa, Polska, NIP: PL5214113655, REGON: 541449095, e-mail: hello@ai25.studio.

  3. AI25.STUDIO jest studiem produkcyjnym specjalizującym się w produkcji filmowej i kreatywnej z wykorzystaniem generatywnej sztucznej inteligencji, live action, 3D, CGI, VFX oraz profesjonalnej postprodukcji.

  4. Serwis ma charakter informacyjny, prezentacyjny i portfolio oraz jest skierowany przede wszystkim do przedsiębiorców, marek, agencji kreatywnych i reklamowych, domów produkcyjnych, studiów postprodukcyjnych oraz innych podmiotów profesjonalnych.

  5. Na potrzeby niniejszego Regulaminu „Użytkownik” oznacza każdą osobę lub podmiot korzystający z Serwisu, „Klient” oznacza podmiot, który zawarł z Usługodawcą umowę dotyczącą realizacji usług, a „Usługi” oznaczają usługi kreatywne, produkcyjne, technologiczne, konsultingowe oraz postprodukcyjne oferowane przez AI25.STUDIO.

  6. „Treści AI” oznaczają materiały, w szczególności obrazy, materiały audiowizualne, dźwiękowe lub inne treści, które zostały wygenerowane, zmodyfikowane lub opracowane z wykorzystaniem systemów lub narzędzi sztucznej inteligencji w ramach procesu produkcyjnego.

  7. Serwis umożliwia zapoznanie się z działalnością, ofertą, portfolio, doświadczeniem i możliwościami produkcyjnymi AI25.STUDIO, kontakt z Usługodawcą oraz przesyłanie zapytań dotyczących potencjalnej współpracy i realizacji projektów.

  8. Zakres działalności AI25.STUDIO obejmuje w szczególności AI video production, reklamy i filmy brandowe, AI commercials, filmy i serie wykorzystujące AI, produkcję hybrydową łączącą live action z generatywnym AI, 3D, CGI i VFX, wizualizację produktową i środowiskową, postprodukcję, montaż, compositing, colour grading, sound design, creative direction, rozwój koncepcji i scenariuszy, AI production strategy, konsultacje kreatywne, rozwój original IP oraz inne powiązane usługi produkcyjne i kreatywne.

  9. Informacje o usługach, cenach, terminach realizacji, zakresie produkcji, technologiach i możliwościach AI25.STUDIO przedstawione w Serwisie mają charakter informacyjny i nie stanowią oferty w rozumieniu art. 66 Kodeksu cywilnego, chyba że wyraźnie wskazano inaczej.

  10. Każdy projekt komercyjny realizowany jest na podstawie indywidualnych ustaleń z Klientem. Szczegółowy zakres prac, harmonogram, wynagrodzenie, liczba rund zmian, sposób dostawy, prawa własności intelektualnej, zasady korzystania z materiałów oraz inne warunki współpracy określane są w indywidualnej umowie, zaakceptowanej ofercie, zamówieniu, statement of work lub innym uzgodnionym dokumencie projektowym.

  11. W przypadku rozbieżności pomiędzy informacjami przedstawionymi w Serwisie lub niniejszym Regulaminie a postanowieniami indywidualnej umowy zawartej z Klientem pierwszeństwo mają postanowienia tej umowy.

  12. Korzystanie z Serwisu oznacza zapoznanie się z niniejszym Regulaminem oraz Polityką Prywatności i Cookies. W zakresie wymaganym przez obowiązujące przepisy odpowiednie zgody, w szczególności dotyczące plików cookies lub podobnych technologii, są pozyskiwane odrębnie.

§2. PRAWA AUTORSKIE I WARUNKI KORZYSTANIA Z SERWISU


  1. Treści i materiały zamieszczone w Serwisie, w szczególności teksty, grafiki, fotografie, materiały wideo, projekty portfolio, elementy identyfikacji wizualnej, układ Serwisu oraz logo AI25.STUDIO, podlegają ochronie na podstawie właściwych przepisów prawa autorskiego, prawa własności przemysłowej oraz innych obowiązujących przepisów.

  2. Korzystanie z Serwisu nie powoduje przeniesienia na Użytkownika jakichkolwiek praw własności intelektualnej ani udzielenia licencji do materiałów dostępnych w Serwisie, chyba że wyraźnie wskazano inaczej.

  3. Bez uprzedniej zgody Usługodawcy zabronione jest kopiowanie, rozpowszechnianie, publikowanie, modyfikowanie lub komercyjne wykorzystywanie materiałów należących do AI25.STUDIO w zakresie wykraczającym poza dozwolony użytek wynikający z obowiązujących przepisów prawa.

  4. Użytkownik zobowiązany jest korzystać z Serwisu zgodnie z obowiązującym prawem, niniejszym Regulaminem oraz przeznaczeniem Serwisu.

  5. Zabronione jest dostarczanie za pośrednictwem Serwisu treści o charakterze bezprawnym, podejmowanie działań mogących zakłócić jego funkcjonowanie, wprowadzanie złośliwego oprogramowania, podejmowanie prób nieautoryzowanego dostępu do Serwisu lub jego infrastruktury oraz automatyczne pozyskiwanie danych z Serwisu w celach komercyjnych bez zgody Usługodawcy.

  6. Do prawidłowego korzystania z Serwisu wymagane są urządzenie z dostępem do Internetu, aktualna przeglądarka internetowa oraz, w zakresie odpowiednich funkcjonalności, aktywny adres e-mail i obsługa JavaScript oraz plików cookies zgodnie z ustawieniami wybranymi przez Użytkownika.

  7. Użytkownik może w każdej chwili zakończyć korzystanie z Serwisu. Korzystanie z formularza kontaktowego lub innych funkcji komunikacji elektronicznej jest dobrowolne.

  8. Prawa do materiałów i rezultatów prac powstających w ramach projektów komercyjnych, w tym materiałów generowanych lub modyfikowanych przy użyciu AI, określane są każdorazowo w indywidualnej umowie zawartej z Klientem. W przypadku rozbieżności pierwszeństwo mają postanowienia tej umowy.

§3. OCHRONA DANYCH, OPINIE I REKLAMACJE


  1. Administratorem danych osobowych przetwarzanych w związku z korzystaniem z Serwisu jest Antoni Shkraba Studio działający pod marką AI25.STUDIO, z siedzibą w Warszawie, NIP: PL5214113655.

  2. Dane osobowe przetwarzane są zgodnie z obowiązującymi przepisami dotyczącymi ochrony danych osobowych, w szczególności Rozporządzeniem Parlamentu Europejskiego i Rady (UE) 2016/679 (RODO). Szczegółowe informacje dotyczące zasad, celów i podstaw prawnych przetwarzania danych, okresów ich przechowywania oraz praw osób, których dane dotyczą, znajdują się w Polityce Prywatności dostępnej w Serwisie.

  3. Serwis może wykorzystywać pliki cookies oraz podobne technologie zgodnie z obowiązującym prawem. Szczegółowe informacje dotyczące wykorzystywanych technologii oraz możliwości zarządzania zgodami znajdują się w Polityce Prywatności i Cookies oraz w mechanizmie zarządzania zgodami dostępnym w Serwisie.

  4. Opinie, rekomendacje i referencje publikowane w Serwisie dotyczą rzeczywistej współpracy, doświadczenia zawodowego lub projektów realizowanych z udziałem AI25.STUDIO, jego zespołu lub współpracowników. W przypadku publikacji danych identyfikujących autora opinii, jego stanowiska, organizacji lub innych informacji osobowych AI25.STUDIO uwzględnia odpowiednie podstawy prawne oraz, gdy jest to wymagane, uzyskane zgody lub inne uprawnienia do publikacji.

  5. AI25.STUDIO dokłada należytej staranności, aby publikowane opinie i referencje były prezentowane rzetelnie i nie wprowadzały w błąd co do charakteru współpracy, osoby autora ani reprezentowanej przez niego organizacji.

  6. Użytkownik może zgłosić reklamację dotyczącą funkcjonowania Serwisu lub usług świadczonych drogą elektroniczną na adres hello@ai25.studio.

  7. Zgłoszenie reklamacyjne powinno, w miarę możliwości, zawierać dane kontaktowe zgłaszającego, opis problemu oraz oczekiwany sposób jego rozwiązania.

  8. Usługodawca rozpatruje reklamację bez zbędnej zwłoki, nie później niż w terminie 14 dni od dnia otrzymania kompletnego zgłoszenia, chyba że charakter sprawy lub obowiązujące przepisy wymagają innego terminu.

  9. Reklamacje lub zastrzeżenia dotyczące indywidualnych projektów komercyjnych, zakresu usług, dostarczonych materiałów, praw własności intelektualnej, wynagrodzenia lub innych warunków współpracy rozpatrywane są zgodnie z postanowieniami odpowiedniej umowy zawartej z Klientem.

§4. ODPOWIEDZIALNOŚĆ I WYŁĄCZENIA, ZMIANY REGULAMINU ORAZ POSTANOWIENIA KOŃCOWE


  1. Usługodawca dokłada należytej staranności, aby Serwis działał prawidłowo oraz zawierał aktualne i rzetelne informacje.

  2. Usługodawca nie ponosi odpowiedzialności za czasową niedostępność Serwisu wynikającą z przyczyn technicznych, prac konserwacyjnych, awarii systemów teleinformatycznych lub działania siły wyższej; szkody wynikające z korzystania z Serwisu w sposób niezgodny z jego przeznaczeniem, obowiązującym prawem lub niniejszym Regulaminem; treści zamieszczone na stronach internetowych osób trzecich, do których odsyłają linki dostępne w Serwisie; decyzje biznesowe, handlowe, produkcyjne lub inwestycyjne podjęte przez Użytkownika wyłącznie na podstawie informacji zawartych w Serwisie, bez uprzedniej indywidualnej konsultacji lub zawarcia odrębnej umowy z Usługodawcą.

  3. Odpowiedzialność Usługodawcy wobec Klienta z tytułu świadczenia usług komercyjnych określana jest każdorazowo w indywidualnej umowie zawartej z Klientem.

  4. Usługodawca zastrzega sobie prawo do zmiany niniejszego Regulaminu, w szczególności w przypadku zmiany funkcjonalności Serwisu, zmiany obowiązujących przepisów prawa, rozszerzenia lub zmiany zakresu oferty Usługodawcy, wdrożenia nowych standardów technologicznych, branżowych lub organizacyjnych albo konieczności doprecyzowania postanowień Regulaminu.

  5. Zmiany Regulaminu wchodzą w życie z chwilą ich opublikowania w Serwisie, chyba że wyraźnie wskazano inny termin ich wejścia w życie.

  6. Aktualna wersja Regulaminu jest zawsze dostępna w Serwisie pod adresem https://ai25.studio/terms-and-conditions.

  7. Dalsze korzystanie z Serwisu po wejściu zmian Regulaminu w życie odbywa się na zasadach określonych w jego aktualnej wersji.

  8. W sprawach nieuregulowanych niniejszym Regulaminem zastosowanie mają przepisy prawa polskiego, w szczególności ustawa z dnia 23 kwietnia 1964 r. – Kodeks cywilny; ustawa z dnia 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną; Rozporządzenie Parlamentu Europejskiego i Rady (UE) 2016/679 (RODO); ustawa z dnia 23 sierpnia 2007 r. o przeciwdziałaniu nieuczciwym praktykom rynkowym; Rozporządzenie Parlamentu Europejskiego i Rady (UE) 2024/1689 z dnia 13 czerwca 2024 r. (EU AI Act) – w zakresie mającym zastosowanie do działalności Usługodawcy, w szczególności obowiązków przejrzystości dotyczących treści generowanych lub modyfikowanych przy użyciu AI.

  9. Spory wynikające z korzystania z Serwisu będą rozstrzygane przez sąd właściwy miejscowo dla siedziby Usługodawcy, z zastrzeżeniem bezwzględnie obowiązujących przepisów prawa.

  10. Niniejszy Regulamin jest udostępniany nieodpłatnie w Serwisie i może zostać pobrany, zapisany oraz odtworzony przez Użytkownika w zwykłym toku czynności.

§5. ZNAKI TOWAROWE, PORTFOLIO I PRZEJRZYSTOŚĆ AI


  1. Znaki towarowe i odniesienia do marek. Nazwy firm, marek, produktów, znaki towarowe, logo oraz inne oznaczenia osób trzecich prezentowane w Serwisie pozostają własnością odpowiednich podmiotów uprawnionych i są wykorzystywane wyłącznie w celach informacyjnych, identyfikacyjnych, referencyjnych oraz portfolio. AI25.STUDIO nie rości sobie praw własności do takich oznaczeń.

  2. Charakter prezentowanych relacji. Odniesienia do marek mogą dotyczyć projektów lub produkcji realizowanych przez AI25.STUDIO, jego założycieli, członków zespołu, współpracowników lub partnerów produkcyjnych, zarówno bezpośrednio, jak i za pośrednictwem agencji, domów produkcyjnych, podwykonawców lub innych podmiotów. O ile wyraźnie nie wskazano inaczej, prezentacja nazwy lub logo danej marki nie oznacza, że była lub jest ona bezpośrednim klientem AI25.STUDIO, ani nie oznacza jej rekomendacji, sponsorowania, certyfikacji, partnerstwa, afiliacji lub innego formalnego powiązania z AI25.STUDIO.

  3. Ograniczenia umowne i prawa osób trzecich. Publikacja materiałów portfolio i odniesień do marek pozostaje każdorazowo z zastrzeżeniem obowiązujących praw własności intelektualnej, zobowiązań do zachowania poufności, postanowień umownych oraz uzgodnionych ograniczeń dotyczących publikacji. W przypadku sprzeczności pierwszeństwo mają odpowiednie postanowienia umowne.

  4. Zgłoszenia właścicieli praw. Właściciel praw lub jego upoważniony przedstawiciel może zgłosić zastrzeżenia dotyczące prezentacji znaku towarowego, logo, odniesienia do marki lub materiału portfolio na adres hello@ai25.studio. AI25.STUDIO rozpatrzy uzasadnione zgłoszenie i, jeżeli będzie to właściwe, dokona odpowiedniej zmiany lub usunięcia materiału. Takie działanie nie stanowi uznania odpowiedzialności przez AI25.STUDIO.

  5. Przejrzystość treści generowanych przez AI. W zakresie, w jakim ma to zastosowanie do danego projektu lub sposobu publikacji, AI25.STUDIO stosuje wymogi dotyczące ujawniania i oznaczania treści generowanych lub modyfikowanych przy użyciu sztucznej inteligencji wynikające z art. 50 Rozporządzenia (UE) 2024/1689 (EU AI Act) oraz uwzględnia zasady EU Code of Practice on Transparency of AI-generated Content. AI25.STUDIO jest sygnatariuszem Section 2 tego Kodeksu. Status sygnatariusza nie stanowi certyfikacji, zatwierdzenia ani rekomendacji AI25.STUDIO przez Komisję Europejską, Unię Europejską ani inny organ publiczny.

  6. Relacja z pozostałymi postanowieniami Regulaminu. W zakresie nazw, znaków towarowych, logo, materiałów portfolio oraz innych oznaczeń należących do osób trzecich postanowienia niniejszego §5 mają pierwszeństwo przed innymi postanowieniami Regulaminu. Żadne postanowienie Regulaminu nie powinno być interpretowane jako oświadczenie, że AI25.STUDIO jest właścicielem lub licencjobiorcą znaków towarowych, logo lub innych oznaczeń osób trzecich, chyba że zostało to wyraźnie wskazane.

  7. Zakres udziału w projektach portfolio. Prezentacja projektu, kampanii, marki lub materiału w portfolio nie oznacza, że AI25.STUDIO było wyłącznym wykonawcą całego projektu, odpowiadało za wszystkie jego elementy ani posiada wszelkie prawa do materiałów wykorzystanych w danej realizacji. Zakres udziału AI25.STUDIO lub członków jego zespołu może różnić się w zależności od projektu.

  8. Status regulacyjny i informacje dotyczące AI. Informacje dotyczące EU AI Act, EU Code of Practice on Transparency of AI-generated Content oraz statusu AI25.STUDIO jako sygnatariusza mają charakter informacyjny i odzwierciedlają status aktualny na moment ich publikacji. Nie stanowią certyfikacji, zatwierdzenia, rekomendacji ani gwarancji zgodności AI25.STUDIO przez Komisję Europejską, Unię Europejską lub inny organ publiczny. Zakres obowiązków prawnych dotyczących danego projektu, systemu lub materiału jest oceniany zgodnie z mającymi zastosowanie przepisami oraz okolicznościami konkretnego przypadku.

  9. Poufność informacji i materiałów. AI25.STUDIO traktuje niepubliczne informacje i materiały przekazywane w związku z potencjalną lub realizowaną współpracą – w szczególności briefy, scenariusze, materiały kreatywne i produkcyjne, niepublikowane kampanie, materiały źródłowe, dane projektowe oraz know-how – a także inne informacje oznaczone jako poufne lub których poufny charakter wynika z okoliczności, z zachowaniem odpowiednich zasad poufności.

    Zakres obowiązków dotyczących poufności, wykorzystywania materiałów Klienta, dostępu do informacji, praw własności intelektualnej oraz możliwości publikacji materiałów w portfolio może być dodatkowo określony w indywidualnej umowie, NDA lub innych uzgodnieniach zawartych pomiędzy stronami.

    Jeżeli pomiędzy AI25.STUDIO a Klientem, partnerem lub innym podmiotem obowiązuje odrębna umowa o zachowaniu poufności (NDA) lub inne postanowienia dotyczące poufności, postanowienia takiej umowy mają pierwszeństwo przed ogólnymi informacjami zawartymi w Serwisie lub niniejszym Regulaminie.

AI VIDEO PRODUCTION STUDIO IN WARSAW, POLAND AI25.Studio provides full-cycle AI video production from Warsaw for clients worldwide. The studio works across advertising, entertainment, branded content, social media, film, episodic content, product communication and experimental storytelling. The production process can begin with a client brief, an existing creative concept or an early-stage idea. AI25.Studio can support concept development, scripting, storyboarding, visual development, art direction and production strategy before moving into AI generation, live-action production, 3D, VFX and post-production. Every project is structured around the final use of the content. Deliverables can be prepared for television, digital advertising, social media, streaming platforms, presentations, out-of-home formats, events, websites and other commercial channels. WHAT AI25.STUDIO PRODUCES AI25.Studio produces AI commercials and advertising campaigns for brands and agencies. Projects can range from short social advertisements and product films to larger commercial campaigns and television-ready productions. The studio produces AI brand films that combine generative imagery with traditional visual storytelling, art direction, editing, sound and post-production. AI25.Studio also develops hybrid productions combining live-action footage with generative AI, 3D environments, CGI elements and visual effects. AI can be used to extend locations, create environments, develop characters, transform existing footage or introduce visual ideas that would otherwise require complex traditional production. For social media campaigns, AI25.Studio produces content in vertical, horizontal and square formats for platforms including Instagram, TikTok, YouTube and other digital channels. Original AI-native storytelling is an important part of AI25.Studio’s research and development work, allowing the team to test character continuity, art direction, world building and narrative consistency across longer runtimes. AI25.Studio develops AI films and series, including episodic concepts, original intellectual property, trailers, pilots and narrative content for entertainment platforms, distributors, brands and production partners. 3D, CGI and VFX production is integrated into the same studio pipeline. Services include product visualisation, environment creation, CGI assets, visual effects, compositing, virtual production workflows and combinations of traditional 3D with generative AI. The studio also works with AI characters, digital humans, virtual presenters, lip sync and multilingual content where these approaches are appropriate for the production. Post-production services include editing, colour grading, compositing, motion design, visual effects, sound design, mixing, multi-platform versioning and preparation of final masters for professional delivery. AI COMMERCIAL AND ADVERTISING PRODUCTION Commercial AI production requires more than generating visually impressive shots. Advertising projects need consistent products, characters, lighting, framing, brand assets, typography, pacing and deliverables across multiple formats. AI25.Studio builds commercial projects around these production requirements from the beginning. The studio can work directly with brands or operate as a production partner for advertising agencies and creative teams. Depending on the project, AI25.Studio can take responsibility for the full production or integrate into an existing agency, director or production-house workflow. This makes the studio suitable for AI commercials, branded films, digital advertising, social campaigns, product launches, pitch films, concept films and experimental campaign work. Projects are developed with creative and production review rather than relying on uncontrolled generations. Shots are selected, refined and finished through a structured production process. AI FILMS, SERIES AND ORIGINAL IP Beyond commercial production, AI25.Studio develops original AI-native films and narrative projects. Original productions include The Mysterious Island, an AI film developed as original studio IP; Adiós, Papi, an AI short film; The Ocean Within, a hybrid short film; Metagenesis, a metaverse concept film; and Every Petal, an AI tribute film. These works are developed, produced and finished inside the studio’s own pipeline. These projects are used to explore longer-form AI filmmaking challenges including recurring characters, visual continuity, film language, emotional storytelling, coherent environments and consistent art direction across multiple scenes. Original IP development also allows the studio to refine production methods that can later be applied to AI films, series, branded entertainment and episodic projects for clients and partners. AI25.Studio’s approach to AI filmmaking starts with story, direction and visual intention before generation. Generative AI performs part of the execution, while creative direction and production decisions remain human-led. HYBRID AI, LIVE ACTION, 3D AND VFX PRODUCTION AI25.Studio is not limited to fully generated video. A core part of the studio’s approach is hybrid production: combining traditional filmmaking with generative AI, 3D, CGI and VFX. A project may begin with live-action footage and use AI to develop environments, characters or visual transformations. Another production may begin primarily in generative AI and use 3D, compositing and conventional post-production to achieve greater control and consistency. This allows AI25.Studio to choose the production method according to the creative problem instead of forcing every project into a single technology. The studio’s six core production areas are Creative Direction, AI Production, Hybrid Production, Post-Production & Finishing, Social & Series Content, and AI Consulting & Enterprise Training. Creative Direction includes concept development, scriptwriting and treatments, storyboarding and previsualization, casting and character design, art direction and visual identity, brand and style direction, and original IP development. AI Production includes generative AI video and image production, AI commercials and brand films, AI film and series production, AI animation, digital humans and AI characters, AI lip sync and dubbing, and custom model training and fine-tuning. Hybrid Production includes live action integrated with AI, 3D, CGI and VFX production, photorealistic product visualisation, green-screen and plate shoots, VFX supervision, on-set AI supervision and virtual production workflows.
