Niniejsza Polityka Prywatności wyjaśnia, w jaki sposób ANTONI SHKRABA STUDIO, działający pod marką AI25.STUDIO, zbiera, wykorzystuje, przechowuje, udostępnia oraz w inny sposób przetwarza dane osobowe w związku z korzystaniem z serwisu internetowego https://ai25.studio, komunikacją biznesową, zapytaniami, realizowanymi projektami oraz powiązanymi usługami.
Dane osobowe są przetwarzane zgodnie z obowiązującymi przepisami dotyczącymi ochrony danych osobowych, w szczególności Rozporządzeniem Parlamentu Europejskiego i Rady (UE) 2016/679 (RODO), ustawą z dnia 10 maja 2018 r. o ochronie danych osobowych oraz innymi właściwymi przepisami prawa polskiego i Unii Europejskiej.

AI25.STUDIO świadczy przede wszystkim profesjonalne usługi kreatywne, produkcyjne i technologiczne w modelu B2B. Serwis oraz oferowane usługi są skierowane głównie do przedsiębiorstw, marek, agencji, domów produkcyjnych oraz innych podmiotów profesjonalnych. Dane osobowe osób działających w imieniu takich podmiotów mogą być przetwarzane zgodnie z niniejszą Polityką Prywatności.
Dane osobowe przetwarzamy wyłącznie wtedy, gdy istnieje odpowiednia podstawa prawna. W zależności od okoliczności przetwarzanie może odbywać się na podstawie zgody zgodnie z art. 6 ust. 1 lit. a RODO, w celu wykonania umowy lub podjęcia działań przed jej zawarciem zgodnie z art. 6 ust. 1 lit. b RODO, w celu wykonania obowiązku prawnego zgodnie z art. 6 ust. 1 lit. c RODO lub na podstawie prawnie uzasadnionego interesu Administratora albo osoby trzeciej zgodnie z art. 6 ust. 1 lit. f RODO, o ile interesy te nie są nadrzędne wobec praw i wolności osoby, której dane dotyczą.
Dane osobowe przetwarzamy zgodnie z zasadami zgodności z prawem, rzetelności i przejrzystości, ograniczenia celu, minimalizacji danych, prawidłowości, ograniczenia przechowywania, integralności i poufności oraz rozliczalności. Przetwarzamy wyłącznie dane odpowiednie i niezbędne do realizacji określonego celu.
W zależności od sposobu kontaktu lub współpracy z AI25.STUDIO możemy przetwarzać dane identyfikacyjne i kontaktowe, w szczególności imię, nazwisko, stanowisko lub pełnioną funkcję, nazwę firmy, adres służbowy, adres e-mail oraz numer telefonu.
W zakresie niezbędnym do prowadzenia relacji biznesowej lub realizacji transakcji możemy przetwarzać dane umowne, rozliczeniowe i księgowe, w szczególności dane przedsiębiorstwa, adres siedziby, NIP lub inne numery identyfikacji podatkowej, informacje związane z płatnościami oraz dokumentację niezbędną do celów księgowych, podatkowych i prawnych.
W związku z zapytaniami oraz realizacją projektów możemy przetwarzać informacje zawarte w korespondencji, briefach, scenariuszach, materiałach referencyjnych, materiałach audiowizualnych, fotografiach, nagraniach, materiałach związanych z marką, plikach produkcyjnych oraz innych materiałach przekazywanych AI25.STUDIO lub tworzonych w ramach współpracy. Materiały te mogą zawierać dane osobowe Klientów, przedstawicieli firm, talentów, wykonawców, współpracowników lub innych osób uczestniczących w projekcie.
Podczas korzystania z Serwisu określone dane techniczne i informacje dotyczące sposobu korzystania z Serwisu mogą być przetwarzane automatycznie, w szczególności adres IP, informacje o urządzeniu i przeglądarce, system operacyjny, odwiedzane strony, źródło wejścia, data i czas wizyty oraz podobne identyfikatory techniczne. Dane zbierane przy użyciu niewymaganych do działania Serwisu narzędzi analitycznych, reklamowych lub podobnych technologii śledzących są przetwarzane zgodnie z zasadami dotyczącymi zgody opisanymi w części poświęconej plikom cookies.
Możemy również otrzymywać dane osobowe od osób trzecich, w szczególności Klientów, agencji, partnerów produkcyjnych, wykonawców, dostawców usług, platform analitycznych lub reklamowych oraz innych partnerów biznesowych. W przypadku pozyskania danych osobowych ze źródła innego niż bezpośrednio od osoby, której dane dotyczą, realizujemy odpowiednie obowiązki informacyjne zgodnie z właściwymi przepisami RODO.
Zewnętrzne platformy lub usługi osadzone w Serwisie, w szczególności materiały wideo, media społecznościowe lub podobne funkcjonalności, mogą niezależnie przetwarzać dane osobowe zgodnie z własnymi politykami prywatności oraz obowiązującymi je przepisami prawa.
AI25.STUDIO co do zasady nie pozyskuje za pośrednictwem Serwisu szczególnych kategorii danych osobowych, o których mowa w art. 9 RODO. Jeżeli realizacja określonego projektu będzie wymagała przetwarzania takich danych, przetwarzanie będzie odbywało się wyłącznie na odpowiedniej podstawie prawnej, przy spełnieniu właściwej przesłanki z art. 9 RODO oraz zastosowaniu wymaganych zabezpieczeń.
Fotografie, nagrania wideo lub inne materiały przedstawiające możliwe do zidentyfikowania osoby stanowią dane osobowe, jeżeli możliwa jest identyfikacja tych osób. Sam fakt przedstawienia wizerunku osoby nie powoduje automatycznie, że materiał stanowi dane biometryczne lub inną szczególną kategorię danych. Jeżeli stosowane jest szczególne przetwarzanie techniczne służące jednoznacznej identyfikacji lub uwierzytelnieniu osoby na podstawie cech biometrycznych, uwzględniane są dodatkowe wymagania prawne dotyczące danych biometrycznych.
Podanie danych osobowych jest co do zasady dobrowolne, chyba że ich podanie wynika z przepisów prawa lub jest niezbędne do zawarcia albo wykonania umowy. Jeżeli określone dane są niezbędne do udzielenia odpowiedzi na zapytanie, przygotowania oferty, zawarcia umowy, wykonania obowiązku prawnego lub realizacji projektu, ich niepodanie może uniemożliwić wykonanie odpowiedniej czynności.
§2. CELE PRZETWARZANIA, AI, ODBIORCY DANYCH, COOKIES I BEZPIECZEŃSTWO
Personal data may be processed in particular for the purpose of handling inquiries, conducting business communication, preparing offers and taking action prior to entering into a contract – on the basis of Art. 6(1)(b) GDPR; concluding and performing contracts and implementing projects – on the basis of Art. 6(1)(b) GDPR; conducting settlements and performing accounting, tax and other legal obligations – on the basis of Art. 6(1)(c) GDPR; ensuring the security of the Website and IT infrastructure, organizing business activities, conducting business relations and establishing, asserting or defending claims – on the basis of the legitimate interest of AI25.STUDIO in accordance with Art. 6(1)(f) GDPR.
Personal data may also be processed for the purpose of conducting analyses, improving the Website, marketing communication, remarketing or other marketing activities. If consent is required for a given type of processing, the basis is Art. 6(1)(a) GDPR and processing begins only after it has been obtained beforehand. If applicable regulations allow another legal basis, processing may take place on that basis, taking into account the rights and freedoms of the data subject.
AI25.STUDIO does not currently make decisions regarding Website users based solely on automated processing, including profiling, which would produce legal effects concerning them or similarly significantly affect them within the meaning of Art. 22 GDPR. If such a processing method is implemented in the future, the data subjects will be provided with the information required by law and ensured appropriate rights and safeguards.
As a studio utilizing generative artificial intelligence technologies, AI25.STUDIO may use AI tools and systems as part of creative, production and post-production processes. If personal data are processed as part of such a process, the processing takes place in accordance with the appropriate legal basis, the terms of the given project, data protection rules and applicable transparency requirements.
AI25.STUDIO selects AI tools and technological solutions taking into account their intended use, terms of commercial use, security, privacy, project requirements and applicable license terms. To the extent applicable to a given method of AI use, AI25.STUDIO takes into account the transparency obligations resulting from Art. 50 of Regulation (EU) 2024/1689 (EU AI Act).
AI25.STUDIO does not use personal data provided by Clients to train its own publicly available AI models. In the case of using third-party AI technology providers, the scope and method of data processing also depend on the terms, account configuration, privacy settings and data protection policies of the given provider. AI25.STUDIO selects and configures the solutions used, taking into account the nature of the project, data protection, confidentiality and the requirements of professional and commercial production processes.
Personal data are stored only for the period necessary to achieve the purpose for which they were collected, and for the period required or justified by applicable provisions of law. Data related to contracts and projects may be stored for the duration of the cooperation, and then for the period necessary for settlements and establishing, asserting or defending claims. Accounting and tax documentation is stored for the period required by applicable legal provisions.
Data related to inquiries that did not lead to the conclusion of a contract may be stored for the period necessary to handle contact and possible further business communication. Data processed on the basis of consent are, in principle, processed until it is withdrawn, unless there is another legal basis for further processing. Data related to cookies and analytical tools are stored in accordance with the settings of the given tool and the information presented in the consent management mechanism.
Personal data may be shared with entities supporting the activities of AI25.STUDIO, in particular providers of hosting and internet infrastructure, analytical tools, communication and office services, production and AI tools, project management systems, accounting, payment, legal, tax services and other services necessary to conduct business.
Such providers may include, in particular, providers of internet platforms, cloud services, analytical, advertising, communication, production and generative tools currently used by AI25.STUDIO. The list of specific providers may change with the development of infrastructure and production processes.
If the provider acts as a processor processing personal data on behalf of AI25.STUDIO, AI25.STUDIO applies the legally required solutions regarding the entrustment of data processing and selects providers taking into account appropriate data protection guarantees.
Data may also be disclosed to public authorities, courts, regulatory bodies or other authorized entities if such an obligation results from legal provisions, as well as to professional advisors to the extent necessary to protect the rights or conduct the activities of AI25.STUDIO.
Some service providers may process data outside the European Economic Area. In such cases, AI25.STUDIO applies, to the extent required by the GDPR, appropriate mechanisms provided for in Chapter V of the GDPR, in particular European Commission decisions establishing an adequate level of protection, standard contractual clauses or other legally permissible safeguards.
The data subject may – to the extent provided for by the GDPR – request access to their data, their rectification, erasure, restriction of processing and data portability, as well as object to processing based on a legitimate interest and to the processing of data for direct marketing purposes.
If the processing is based on consent, consent may be withdrawn at any time without affecting the lawfulness of processing based on consent before its withdrawal. A person who believes that their personal data are being processed unlawfully has the right to lodge a complaint with the competent supervisory authority, in particular the President of the Personal Data Protection Office (UODO).
The Website uses cookies and similar technologies, such as browser local storage, pixels, tags or scripts. These technologies may be used to ensure the proper functioning of the Website, remember settings, conduct analyses, measure the effectiveness of the Website and – after obtaining the required consent – conduct marketing and advertising activities.

Security measures may include, in particular, access control, authentication mechanisms, appropriate security of systems and accounts, creation of backup copies, limiting access to data in accordance with the scope of duties, encryption or pseudonymization in appropriate cases and periodic reviews of the security measures used.
In the event of a personal data breach, AI25.STUDIO takes the actions required by the GDPR, including – if the appropriate conditions are met – reporting the breach to the competent supervisory authority and informing the data subjects.
If the planned processing, in particular with the use of new technologies, is likely to result in a high risk to the rights and freedoms of natural persons, AI25.STUDIO carries out – when required by regulations – a Data Protection Impact Assessment (DPIA) in accordance with Art. 35 GDPR.
When introducing new technologies, including AI systems and tools, AI25.STUDIO assesses their impact on the method of data processing and the need to apply additional safeguards, documentation or conduct a DPIA, as appropriate to the nature and risk of the specific process.
§3. ZMIANY POLITYKI, INFORMACJE KOŃCOWE I KONTAKT
Niniejsza Polityka Prywatności może być okresowo aktualizowana, w szczególności w związku ze zmianami przepisów prawa, sposobu funkcjonowania Serwisu, zakresu działalności AI25.STUDIO, wykorzystywanych technologii, dostawców usług lub procesów przetwarzania danych osobowych.
Aktualna wersja Polityki Prywatności jest publikowana w Serwisie wraz z datą jej ostatniej aktualizacji. Jeżeli charakter zmian będzie tego wymagał zgodnie z obowiązującymi przepisami, osoby, których dane dotyczą, zostaną o nich poinformowane w odpowiedni sposób lub zostanie ponownie pozyskana wymagana zgoda.
Zmiana niniejszej Polityki Prywatności nie wpływa na zgodność z prawem przetwarzania dokonanego przed jej wejściem w życie ani nie ogranicza praw przysługujących osobom, których dane dotyczą, na podstawie obowiązujących przepisów prawa.
Przetwarzanie danych osobowych pracowników, stałych współpracowników, kandydatów, wykonawców lub innych osób pozostających z AI25.STUDIO w szczególnej relacji zawodowej może podlegać dodatkowym lub odrębnym obowiązkom informacyjnym odpowiednim dla charakteru danej relacji. Niniejsza Polityka nie zastępuje takich indywidualnych informacji, jeżeli ich przekazanie jest wymagane przez obowiązujące przepisy.
